Man wants 2018 case dismissed

A man currently charged with numerous crimes in Baxter County related to a 2018 incident has a pending motion to dismiss his case for alleged violation of his right to expeditious trial.

32-year-old Christopher Alan Everett, who lists an address in Little Rock, has faced 13 burglary or burglary, 18 property theft, 6 criminal mischief, and 2 commercial break-in.

There were 13 different victims in the Baxter County case, with redress estimated at nearly $ 21,000, according to the probable cause affidavit.

He was in jail or in jail for most of the incident in Baxter County, where his charges of burglary and theft stem from late September 2018.

Because of his detention, the Baxter County arrest warrant was not served until late last month.

When Everett was arrested in Batesville on September 26, 2018, he was in the truck that was reported stolen from Gassville.

He was sentenced to 10 years in prison by the Independence County Circuit Court and detained in the North Central Unit of the state prison system in Calico Rock.

Everett ?? acting as his own attorney – is a prolific complainant. He has filed lawsuits against a prison in another county, the state prison system, and a number of employees who work in those detention centers.

He has alleged incidents in which he was beaten, refused medical treatment, kept in isolation for long periods and forced to admit guilt.

Everett also claims that his mental health problems were not properly addressed.

Everett’s lawsuits have been examined in county courts, federal district courts, the 8th Court of Appeals, and the Arkansas Supreme Court.

They were generally found without merit.

He has filed records alleging a violation of his right to expedite trial in the Baxter County case, but no decision has been taken on the petition.

According to the affidavit in the Baxter County case, the owners of two companies located in the same building in Gassville reported that property had been stolen, including a 1985 Honda 650 motorcycle.

Gassville Police found the motorcycle. The driver told investigators that he had been paid to take the motorcycle to a certain location by a man he only knew as a “good luck charm”.

The man said he did but “Lucky” was nowhere to be seen, so he rode his bike back to Mountain Home.

Surveillance cameras at a Mountain Home gas station showed Everett meet the man and apparently arrange the transaction to move the bike to another location.

The name “Lucky” apparently speaks to Everett. While in custody in Calico Rock, he filed an application with the Izard County Circuit Court to change his name to “Lucky Phoenix Kloud”.

In his petition, Everett wrote that his name change was based on religious belief.

During the 2018 robbery in Gassville, suspects are said to have found a lock box with the keys to each car on the premises of one of the companies – Auto Worx.

All vehicles were driven through. According to investigators, a 2010 Ford pickup was stolen from Sanders Auto Sales. It was in this truck that Everett was arrested in Batesville.

During his time in jail, he began filing lawsuits to have his sentence waived in the Independence County case for a variety of reasons.
