Core agrees to pay a $6.5 million civil penalty for failing to report serious injuries to its exercise equipment

WASHINGTON, January 31, 2022 /PRNewswire/ — The US Consumer Product Safety Commission (CPSC) announced that Core Health & Fitness LLC of Vancouver, Washington, has agreed to a $6.5 million civil penalty. The Settlement resolves CPSC’s allegations that Core failed to promptly report to CPSC as required by law that its Cable Cross Over Machines and Dual Adjustable Pulley Machines were defective or created an unacceptable risk of serious injury.

CPSC claimed Core had information that the height adjustment sleds on the machines could detach and fall, posing a serious risk of injury to the user. Core received reports of 55 falling cart incidents, including 11 incidents that resulted in head injuries requiring stitches or staples, but Core did not immediately notify the CPSC of the defect or risk.

In addition to paying the $6.5 million Civil Penalty has agreed to maintain an enhanced compliance program to Core to ensure compliance with the Consumer Product Safety Act (CPSA). Core will also maintain an appropriate system of internal controls and procedures to ensure that information required to be shared by Core with the Commission is recorded, processed and reported in accordance with applicable law.

The penalty agreement was provisionally accepted by the commission by a vote of 4-0.
